Canadian notice-and-notice

Seyuna accepts a written notice of claimed infringement under sections 41.25 and 41.26 of Canada'sCopyright Act by email atdmca@seyuna.com. You do not need to use the form below or provide U.S.-specific declarations. A Canadian notice should include:

  • the claimant's name and address and contact information;
  • the copyrighted work or other subject matter;
  • the claimant's copyright interest or right;
  • the exact electronic location of the material;
  • the infringement claimed; and
  • the date and time of the claimed infringement.

A Canadian statutory notice must not contain an offer to settle, a request or demand for payment or personal information, or a link to such an offer, request or demand. Where the statutory forwarding duty applies, Seyuna forwards a compliant notice electronically as soon as feasible and tells the claimant whether it was forwarded or why forwarding was not possible. Seyuna retains identity records for six months from receipt, or for one year from receipt if the claimant starts proceedings and gives Seyuna notice before the six-month period ends, as the Act requires.

United States DMCA notice

This form sends a notice to Seyuna's designated agent and collects the elements of a notice under 17 U.S.C. § 512(c)(3). Its additional phone, signature and declaration fields are not conditions for Seyuna to accept a compliant Canadian notice by email.

Counter-notice

Send a counter-notice to dmca@seyuna.com. Include your name, address and telephone number; identify the removed material and its prior location; state under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification; consent to the jurisdiction required by applicable law and accept service from the original claimant; and sign the notice. We may share a notice or counter-notice with the affected parties where necessary to process it.
